I.Data Protection Declaration Website

§ 1 Information Regarding the Collection of Personal Data

  1. In this section, we will provide information about the way we collect personal data when you use our website. Personal data shall include all information that relates to you personally, e.g., name, address, email addresses, user behaviour.
  2. Your data will be stored on the servers of Wilsonart Americas, 2501 Wilsonart Drive, P.O. Box 6110, Temple, Texas 76503-6110, USA. For the transmission of your personal data, Resopal GmbH has concluded formal contractual agreements with Wilsonart Americas. Upon request, a copy of the EU Standard Contractual Clauses concluded for the purpose is available for you. You may send your request to the following email address: datenschutz@resopal.de. The legal basis is found in Art. 6 para. 1 sentence 1 (f) of the GDPR.  

Your data shall be deleted on the servers as soon as you exercise your right of revocation with respect to the consent you had given or when you object to the processing of your personal data, as long as there is no conflict with statutory retention periods.

When you contact us via email or by filling out a contact form, we store the information you share with us (your email address, your name and your telephone number, if applicable) to enable us to respond to your questions. Once the storage is no longer necessary, we delete the information obtained in this connection or restrict the processing should statutory retention periods apply.
  3. In the event that we commission designated service providers for individual functions of our offer or wish to use your data for commercial purposes, we will inform you in detail below regarding the procedures involved. At the same time, we will specify the criteria established for the storage duration.

§ 2 Your Rights

  1. In the relationship with us, you have the following rights with respect to the personal data relating to you:

§ 3 Personal Data Collected When You Visit Our Website

  1. When you use our website merely for informational purposes, i.e., when you don’t sign up (register as a user) or otherwise transmit information to us, we collect only the personal data which your browser transmits to our server. If you want to look at our website, we collect the following data, as they are a technical requirement for us to display our website for you and to warrant the stability and security (The legal basis is found in Art. 6 para. 1 sentence 1 (f) of the GDPR):

  • date and time of the enquiry
  • time zone difference from Greenwich Mean Time (GMT)
  • content of the request (specific page)
  • access status/HTTP status code
  • volume of data transmitted in each case
  • website from which the request is coming
  • browser
  • operating system and its interface
  • language and version of the browser software.
  1. In addition to the aforementioned information, cookies are stored on your computer as you use our website. Cookies are small text files that are stored on your hard disk drive assigned to the browser you are using and through which the entity which sets the cookie (in this case meaning us) receives specific information. Cookies cannot run programmes or transfer viruses to your computer. They serve to make the web presence generally more user-friendly and more effective.
  2. Use of Cookies:
    1. This website uses the following types of cookies, the scope and operating principles of which are explained below:
  • Persistent cookies.
    1. Persistent Cookies are automatically deleted after a predetermined period of time which may differ depending on the cookie. You can deactivate the cookies in the security settings of your browser at any time.
    2. You can configure your browser setting according to your wishes and, for example, refuse to accept third-party cookies or all cookies. Please note that it is possible that then you may not be able to use all the features of this website.
    3. We use cookies to allow us to identify you for subsequent visits if you have an account with us. Otherwise you would have to log in again for each visit.
    4. The flash cookies used are not identified by your browser; your flash plug-in does this. We also use HTML5 storage objects which are stored on your terminal. These objects store the required data regardless of the browser you are using and have no automatic expiry date. If you do not want the flash cookies to be processed, you must install an appropriate add-on, for example, “Better Privacy” for Mozilla Firefox (https://addons.mozilla.org/de/firefox/addon/betterprivacy/) or the Adobe flash killer cookie for Google Chrome. You can prevent the use of HTML5 storage objects by using private mode in your browser. We also recommend that you manually delete your cookies and browsing history on a regular basis.

§ 4 Additional Functions and Services of Our Website

  1. In addition to the purely informational use of our website, we also offer a range of services for you to use if you are interested. As a general rule, this requires that you provide additional personal data which we use to provide the respective service and to which the abovementioned principles for processing data apply.
  2. To some extent, we will use external service providers to process your data. These professionals have been carefully selected and commissioned by us. They are subject to our instructions and are regularly inspected by us.
  3. We may furthermore forward your personal data to third parties in cases where we work together with partners to allow you to take advantage of special offers, participate in sweepstakes, conclude contracts or enter into other activities. You will be provided with further information once you supply your personal data or you can find it below the description of the offer.
  4. In the event that our service providers or partners have their registered office in a country outside of the European Economic Area (EEA), we will include, in the description of the offer, information as to the effect of this circumstance.

§ 5 Objection to the Processing of Your Data or Revocation of the Consent Provided

  1. If you have granted consent for the processing of your data, you can revoke it at any time. Such declaration of revocation affects the permissibility of the processing of your personal data after you have expressed it to us.
  2. Insofar as we base the processing of your personal data on an assessment of interests, you can file an objection to the processing. This is the case if, in particular, the processing is not required to fulfil a contract concluded with you as we represent it in the subsequent description of the features. If you do object to the processing, we kindly ask for an explanation of the reasons why we should not process your personal data in the way we have done it. In the case of a justified objection, we will examine the situation and either discontinue or adapt the data processing or demonstrate to you our compelling legitimate reasons on the basis of which we will continue the processing.

II.Data Protection Declarations for Analytics Tools

§ 1 Use of Google Analytics

  1. For the purpose of designing our webpages to meet the demands and to improve them on an ongoing basis, we use Google Analytics, a web analysis service provided by Google Inc. (https://www.google.de/intl/de/about/) (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter “Google”). In this connection, pseudonymised user profiles are created and cookies (also refer to Section I §3 number 3) are set.
  2. The information generated by the cookie regarding your use of this website, such as browser type/version, operating system used, referrer URL (previously visited page/site), host name of the accessing computer (IP address) and the time of the server request is, as a rule, transmitted to a server of Google in the USA and is stored there. However, if the IP anonymisation is activated on this website, then within the Member States of the European Union or in other states which are contracting parties to the Agreement on the European Economic Area, your IP address is truncated beforehand by Google. The information is used to evaluate the use of the website in order to compile reports regarding the website’s activities and to provide further services in connection with the usage of the website and the Internet for the purposes of market research and the demand-based design of these webpages. It is in these purposes, too, that we have a justified interest with respect to the data processing. The legal basis for the use of Google Analytics is § 15 para. 3 of the German Telemedia Act (TMG) in conjunction with Art. 6 para. 1 (f) of the GDPR.
  3. This information will be, if necessary, also transmitted to third parties provided that it is required by law or insofar as third parties are commissioned to process these data. Under no circumstances will your IP address be merged with other Google data. The IP addresses are anonymised, meaning that no assignment is possible (the so-called IP masking).
  4. Data we sent linked with cookies, user identifiers (e.g., user ID) or advertising IDs are automatically deleted after 14 months. The deletion of data whose retention period has been reached takes place automatically once a month.

  6. You can prevent the installation and storage of cookies by setting your browser software accordingly; we point out, however, that in such case you may not be able to use all the functions of this website to their full extent.
  7. Furthermore, you can prevent the collection of cookie-generated data relating to your use of the website (incl. your IP address) as well as the processing of these data by Google by downloading and installing the browser plug-in available at the following link https://tools.google.com/dlpage/gaoptout?hl=en.
  8. As an alternative to the browser add-on, especially in the case of browsers on mobile devices, you can prevent the data collection by Google Analytics if you click on the following link. An opt-out cookie is then set which will prevent the future collection of your data when you visit this website: Deactivate Google Analytics. The opt-out cookie is valid in this browser only and only for our website and is saved on your device. If you delete the cookies in this browser, you will have to again set the opt-out cookie.
 

 

III.Data Protection Declaration Social Media

§ 1 Use of Social Media Plugins

  1. We are currently using the following social media plug-ins: Facebook, Google+, Twitter and YouTube. Here we use the so-called two-click solution. This means that when you visit our website, to begin with, basically no personal data are forwarded to the providers of the plug-ins. You can recognise the provider of the plug-in by the marking on the box above the initial or the logo. We provide you with the option of using the button to communicate directly with the provider of the plug-in. It is only when you click on the marked field, thus activating it, that the provider of the plug-in receives the information that you have called up the corresponding webpage of our online offer. In addition to this, the data cited under I § 3 of this Declaration are transmitted. In the case of Facebook, according to the respective providers in Germany, the IP address is anonymised immediately after being collected. When the plug-in is activated, your personal data are then sent to the respective plug-in provider and stored there (in the case of US providers, in den USA). Since the plug-in provider collects the data mainly with the use of cookies, we recommend that you use the security settings of your browser to delete all cookies before clicking on the greyed-out box.
  2. We have no influence on the collected data or data processing transactions, nor are we aware of the full extent of the data collection, the purposes of the processing or the storage durations. We also have no information regarding the plug-in provider’s deletion of the collected data.
  3. The plug-in provider stores the data collected from/about you as usage profiles and uses them for advertising purposes, market research and/or the demand-based design of the website. Such an evaluation takes place in particular (also for users who are not logged in) for the purpose of providing demand-based advertising and to inform other users of the social network about your activities on our website. You have the right to object to the creation of these user profiles. To exercise this right, you must address the respective plug-in provider. We offer the plug-ins to give you an opportunity to interact with the social networks and with other users, as this will in turn allow us to improve our offer and make it more interesting for you as the user. The legal basis for the use of the plug-ins is Art. 6 para. 1 sentence 1 (f) of the GDPR.
  4. The data are passed on regardless of whether you have an account with the plug-in provider and are logged in there. If you are logged in with the plug-in provider, the data we collected about you are assigned directly to the account you have with that plug-in provider. When you press the activated button and, for example, link to the website, the plug-in provider also stores this information in your user account and publicly shares it with your contacts. We recommend that you regularly log out of a social network, in particular, however, before activating the button, since this will allow you to prevent the assignment to your profile with the plug-in provider.

§ 2 AddThis Bookmarking

  1. Our websites also include AddThis plug-ins. These plug-ins allow you the placing of bookmarks and/or the sharing of interesting content with other users. With these plug-ins we give you an opportunity to interact with the social networks and with other users, as this will in turn allow us to improve our offer and make it more interesting for you as the user. The legal basis for the use of the plug-ins is Art. 6 para. 1 sentence 1 (f) of the GDPR.
  2. Your internet browser uses these plug-ins to establish a direct connection with the servers of AddThis and, if required, with the social network or bookmarking service. The recipients are sent the information that you have called up the respective website of our online offer and the information cited under I § 3 of this Declaration. This information is processed on the servers of AddThis in the USA. If you send content of our website to social networks or bookmarking services, a connection can be created between the visit of our website and your user profile at the corresponding network. We have no influence on the collected data or data processing transactions, nor are we aware of the full extent of the data collection, the purposes of the processing or the storage durations. We also have no information regarding the plug-in provider’s deletion of the collected data.

§ 3 Integration of Google Maps

  1. On this website, we make use of the Google Maps offer. It allows us to display interactive maps directly on the website, thus enabling you to comfortably use the map function.
  2. With your visit on the website, Google receives the information that you have accessed the corresponding subpage of our website. In addition, the data cited under I § 3 of this Declaration are transmitted. This happens regardless of whether Google provides a user account where you are logged in or when there is no user account. If you are logged in to Google, your data will be assigned directly to your account. If you do not want your data to be assigned to your Google profile, you will have to log out before activating the button. Google stores your data as usage profiles and uses them for advertising purposes, market research and/or the demand-based design of its website. Such an evaluation takes place in particular (also for users who are not logged in) for the purpose of providing demand-based advertising and to inform other users of the social network about your activities on our website. IV.Special Ways to Use Websites

§ 1 Use of our Webshop

  1. When you want to place an order on our webshop, it is necessary for the conclusion of a contract that you create a customer account and enter your personal data, as we need these to process your order. Mandatory information necessary for executing the contract is specially marked, while additional information is voluntary. We process the information you have disclosed to enable us to complete your order. For this purpose, we may pass your payment information to our house bank. The legal basis for this is found in Art. 6 para. 1 sentence 1 (b) of the GDPR.

With your customer account we can store your data for further purchases later on. If you create an account under “My Account”, the data you enter there are stored until you revoke your consent. You can delete all other data, including your user account, in the customer area at any time.

We may also process the data you have entered to inform you about other interesting products from our portfolio or to send you emails with technical information.

  1. We are obliged under commercial and tax laws to store your address as well as payment and order data for a period of ten years. However, after two years, we will restrict the processing, meaning that your data are then used for no other purpose than to comply with the applicable statutory obligations.
  2. In order to prevent unauthorised third-party access to your personal data, in particular your financial data, the order process is encrypted by means of TLS technology.

§ 2 Use of our Portal

  1. If you want to use our portal, it is necessary that you register by specifying your email address, a password you have selected and also the user name of your choice. It is not a requirement that you provide your identifiable, real name; the use of a pseudonym is possible. We employ the so-called double opt-in procedure for the registration, which means that your registration is not completed until you confirm your wish to sign up by clicking on the link in a confirmation email sent to you for that purpose. If we do not receive the confirmation within 24 hours, your registration request will be automatically deleted from our data base. The specification of the abovementioned data is obligatory. You can freely enter any additional information as you use our portal.
  2. When you use our portal, we store the data necessary for the fulfilment of the contract, including the payment method, until you definitively delete your access. Furthermore, we will store the voluntary data you entered for as long as you use the portal, unless you have previously deleted them. You will be able to manage and modify all information in the protected customer area. The legal basis is found in Art. 6 para. 1 sentence 1 (f) of the GDPR.
  3. In order to prevent unauthorised third-party access to your personal data, in particular your financial data, the connection is encrypted by means of TLS technology.
